One of the most important functions of the government is to keep records because this is the only viable and efficient way that the government could fulfil one of their mandates which is to inform their constituents of the things that they are doing and the things that may have effect upon the lives of said constituents. The records made by the government are collectively referred to as public records and an example of such public records would be San Benito County Public Records, which are supposed to be available to the public at all times.


As the official records of the government, these records are the best evidence that one could present in order to prove the fact that is reflected upon these records, but it must be noted that the records are rather limited in what they could provide because the records are physical and could only hold so much information without getting bulky. This means that while it is true that the contents of the records are presumed to be true and accurate at all times, this presumption applies only in regards to what is actually written on the records and nothing else. Thus, if the divorce records that are being presented would have references to a wedding that must be necessary before there could be a divorce, the fact of the wedding still could not be established by the divorce records that are being presented.

Public records are also given the presumption only if they were obtained from the proper sources, thus, this means that while there is no obligation on the part of the person presenting the records from proving that the contents of the records are true and accurate, there is still the obligation to prove that the records were obtained from the proper sources, though it must be noted that proving that the record were obtained from the proper source is still easier than proving that the contents of the records are true and accurate.

A request for copies of the public records would require that the person who is going to make the request be aware of the location of the records. Most records are kept at the place that made them in the first place, and often, it is only upon such offices where request for copies could be made. As for the procedure, that would also usually depend on the office where the request would be made, though it would usually be through the mail or in person, with both methods having their own inherent set of advantages and disadvantages that must be taken into consideration by the person making the request.

Copies of San Benito County Court Records could also be found online through the use of online databases, and while these databases are not official sources, they could present information that would practically be the same as that which could be found from the official sources. Note, however, that they are not official sources for the purpose of the presumption of regularity because they are not official sources.
